TAIWAN’S HTC SUED FOR PATENT INFRINGEMENT BY GEMALTO

Gemalto NV, a Netherlands-based provider of digital security services, said on Monday it had filed a lawsuit in a district court in the United States against Taiwan’s smartphone maker HTC Corp. (TAIEX:2498) for patent infringement.

Gemalto is also suing U.S.-based Google Inc. and Motorola Inc., as well as Samsung Electronics (KSE:005930) of South Korea, claiming all four had infringed its patents by using its technologies in Google’s Android operating system, a statement issued by the company stated.

The patented technologies were developed at Gemalto’s research and development
base in Texas in the 1990s, claimed the lawsuit, filed in the Eastern District of Texas.

Gemalto said the patents were fundamental to running software developed in a programming language such as Java on a resource- constrained device.

“Gemalto is recognized as a pioneer and ground-breaking contributor to the JavaCard — one of the devices for which the patented technologies were conceived, ” the company said in the statement.

“This lawsuit is necessary to protect our investment in innovation, ” Gemalto said. “The technologies we develop and associated intellectual property rights are essential to Gemalto’s future.”

HTC was not immediately available for comment on the litigation.

According to Gartner, an information technology research firm, Android ranked as the U.S. number one and world number three most popular smartphone operating system after overtaking Apple’s iPhone OS.
